Individual Membership Agreement

The subject matter of the Agreement is to determine the conditions under which the Member may use the individual membership services offered on the Imotilist platform, as well as the rights and obligations of the parties.

To hold an individual membership, you must be at least 18 years old and have legal capacity. The Member undertakes that the information provided during registration is accurate and up to date. One person cannot open more than one individual membership account.

• You can register with an email address, a phone number or a social account.
• Account ownership is verified with a verification code.
• If false information is provided, the membership may be cancelled.

The Member has the right to view listings, create favorites and saved searches, receive notifications, publish listings and contact agents. The Member is obliged to use the platform in accordance with the law and the rules of good faith, to ensure the security of the account and not to share their password with third parties.

Imotilist is obliged to provide the service with reasonable care. The service may be temporarily interrupted due to maintenance, updates or force majeure. Imotilist has the right to temporarily or permanently close the account of a Member who acts in breach of the Agreement. Decisions to close or suspend an account are notified with reasons, and such decisions may be appealed through the means set out in Article 5.1 of the Terms of Use.

Individual membership is free of charge. The prices of paid services such as promotion and valuation reports are listed on the Price List page, while the payment and withdrawal conditions can be found on the Pre-Contractual Information and Distance Sales Terms and Refund and Withdrawal Terms pages (Закон за защита на потребителите, ЗЗП чл. 47 et seq.).

The Member's personal data is processed in accordance with the EU General Data Protection Regulation (Regulation (EU) 2016/679, “GDPR”) and the Закон за защита на личните данни (ЗЗЛД). For detailed information, you can review the User Data Privacy Notice. Promotional emails and notifications are sent only with the Member's prior consent (ЗЕТ чл. 6, GDPR Art. 6(1)(a)). This consent can be withdrawn at any time via the link in each message or in your account settings.

The Agreement is of indefinite duration, and the Member may terminate it at any time by closing their account. Closing the account does not prevent data that falls under statutory retention obligations from being retained until the retention period expires. For retention periods, please see Article 6 of the Privacy Notice.

The Agreement enters into force at the moment it is confirmed electronically by the Member. The law of the Republic of Bulgaria applies to the Agreement, and the competent Bulgarian courts in Sofia have jurisdiction. Consumers' rights arising from the mandatory provisions of their country of residence, their right to apply to the courts at their place of residence, and their right to apply to the Помирителна комисия within the Комисия за защита на потребителите (КЗП) are reserved.
