Terms of Use
This is sample text and requires legal review. This text should be reviewed by a lawyer before it is published.
These Terms of Use govern the use of the website and mobile applications (the “Site”) operated by XOUNOX (“Imotilist”), established in the Republic of Bulgaria. Anyone who visits or uses the Site declares that they have read, understood and accepted these terms. The company's commercial register number (ЕИК), VAT (ДДС) number and address are set out in the Seller Information section of the Pre-Contractual Information page (ЗЕТ чл. 4).
For details on how your personal data is processed, we also recommend that you review our User Data Privacy Notice and Cookie Policy.
1. Parties and Scope
These terms apply between Imotilist and the natural and legal persons who use the Site (“User”). Imotilist is an online platform that publishes property purchase, sale and rental listings and brings listing owners and people searching for properties together.
Imotilist is a hosting service and online platform within the meaning of the Digital Services Act (Regulation (EU) 2022/2065, “DSA”), and an information society service provider within the meaning of the Закон за електронната търговия (ЗЕТ). Imotilist is not a party to the sale or rental contracts relating to the properties advertised, does not act as a real estate intermediary, and is not responsible for the performance of those contracts.
2. Description of the Service
Imotilist offers services such as listing publication, listing search and filtering, map-based search, property valuation, market data, an agent and agency directory, a blog and an AI-powered assistant. Significant changes to the scope of the services are announced in accordance with Section 8 of these terms.
- Posting, editing and removing listings
- Advanced search, saved searches and favorites lists
- Agent and real estate agency profiles and communication tools
- Price trends, valuation estimates and regional market reports
3. Membership and Account Security
Membership is required to use some of the services. You must be at least 18 years old to become a member. The User is responsible for ensuring that membership information is accurate, up to date and complete. The User is responsible for keeping account credentials confidential and for all actions carried out through the account.
If unauthorized use is suspected, the User must inform Imotilist without delay. Membership details are governed by the Individual Membership Agreement.
4. Listing Publication Rules
Listing owners are responsible for the accuracy and currency of the listings they publish, for their compliance with applicable Bulgarian and EU legislation (including consumer, advertising, intellectual property and personal data legislation), and for ensuring that they do not infringe the rights of third parties. Imotilist may review listings for compliance with these terms and the law, and may reject them, restrict their visibility or remove them. In such cases, a reasoned notice is sent to the listing owner in accordance with DSA Art. 17.
- Listings containing false, misleading or incomplete information may not be posted.
- Photographs, text or trademarks belonging to others may not be used without permission.
- Duplicate listings may not be published for the same property.
- Content that is unlawful, insulting or contrary to public morality may not be published.
- Real estate agencies clearly state their trade names in listings; a professional advertiser may not present itself as an individual user.
- Real estate agencies are personally responsible to their clients for their own legal obligations (including consumer legislation and the Закон за мерките срещу изпирането на пари).
5. Prohibited Uses
Scraping the Site by automated means, copying content without permission, circumventing security measures, disrupting the service or spreading malware is prohibited. When such actions are detected, Imotilist may suspend the membership and pursue legal remedies.
Imotilist may suspend, for a reasonable period and after issuing a prior warning, the accounts of users who frequently publish manifestly illegal content or frequently submit unfounded notices (DSA Art. 23).
5.1. Reporting Illegal Content and Content Decisions
You can report a listing or content that you consider illegal using the “Report” link on the listing page or by writing to [email protected]. Your notice should include an explanation of why the content is illegal, the exact address (URL) of the content, your name and email address, and your statement that the notice is submitted in good faith and is accurate (DSA Art. 16). We confirm receipt of the notice and inform you of our decision and the available means of redress.
Content decisions are made with human oversight. Where automated tools are used, this is stated in the decision. In our decisions to remove content, restrict its visibility or suspend an account, we explain the reasons, the rule relied upon and the available means of appeal (DSA Art. 17).
You may appeal a decision free of charge within 6 months of being notified of it, through your account or via [email protected] (DSA Art. 20). You also retain the right to turn to out-of-court dispute settlement bodies certified by the Комисия за регулиране на съобщенията (КРС), the Digital Services Coordinator in Bulgaria (DSA Art. 21), or to go to court.
If a criminal offense threatening the life or safety of persons is suspected, the competent authorities are informed (DSA Art. 18).
5.2. Ranking and Paid Visibility
Search results are ranked by default according to criteria such as publication date, relevance to your filters and the completeness of listing information. Paid products such as Highlight, Showcase, Platinum Showcase and Social Showcase increase the ranking and visibility of a listing. These listings are clearly marked with a “Featured” / “Showcase” label (DSA Art. 26-27, P2B Art. 5, ЗЕТ чл. 5).
6. Intellectual and Industrial Property Rights
The design, software, trademarks, logos and content of the Site are protected under the Закон за авторското право и сродните му права, the Закон за марките и географските означения and relevant EU legislation. They may not be reproduced, distributed or used for commercial purposes without Imotilist's written permission.
The listing owner grants Imotilist a non-exclusive, royalty-free license, limited to the period during which the listing remains published, to use the photographs and text they upload for the purpose of publishing and promoting the listing on the Site.
7. Limitation of Liability
The listing owner is responsible for the accuracy of the information and images in listings. Imotilist cannot be held liable for disputes between users, for any guarantee that the service will be uninterrupted or error-free, or for the accuracy of valuations and market data. Valuations are for informational purposes only and do not replace an appraisal report.
When Imotilist gains actual knowledge that content is illegal, it removes it or disables access to it without delay (DSA Art. 6). These limitations do not apply in cases of intent or gross negligence, or with respect to consumers' mandatory statutory rights.
7.1. Real Estate Agencies and Business Users
Business accounts are business users within the meaning of Regulation (EU) 2019/1150 (P2B Regulation). Changes to these terms that affect business users are announced by email and dashboard notification at least 15 days before they take effect. The business user may terminate the agreement within this period (P2B Art. 3). Details are on the Business Membership Agreement page.
The restriction or suspension of a business account is notified with a statement of reasons. The complete termination of the service is notified, with a statement of reasons, at least 30 days in advance, except in cases of legal obligation or serious breach (P2B Art. 4). Business users may send their complaints to [email protected].
Business users are not consumers. The right of withdrawal under the ЗЗП does not apply to business purchases.
8. Changes and Dispute Resolution
Imotilist may update these terms. Significant changes are announced on the Site and by email before they take effect (at least 15 days in advance for business users). The updated text takes effect on the date stated in the announcement.
The law of the Republic of Bulgaria applies to these terms. The competent Bulgarian courts in Sofia have jurisdiction over disputes. This choice does not remove the protection consumers derive from the mandatory provisions of the country of their habitual residence, nor their right to bring proceedings before the courts of their place of residence (Regulation (EC) 593/2008 Art. 6, Regulation (EU) 1215/2012 Art. 17-19).
Consumers may apply for alternative dispute resolution to the Помирителна комисия within the Комисия за защита на потребителите (КЗП, https://kzp.bg) (ЗЗП чл. 181а et seq.). The EU's online dispute resolution (ODR) platform was closed on 20 July 2025.
